Terms of Service

Effective date: July 11, 2026

These Terms of Service ("Terms") govern your use of the BingeMates mobile application (the "App"), provided by BingeMates LLC ("BingeMates," "we," "us," or "our"). By creating an account or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility and availability

You must be at least 13 years old to use the App. If you are under the age of majority where you live, you may use the App only with the involvement of a parent or guardian. By using the App, you represent that you meet these requirements.

The App is intended for use only by residents of the United States. BingeMates LLC is based in the United States, and the App is controlled and operated from the United States; we make no representation that the App is appropriate or available for use in other locations. Certain features, including streaming-availability information, are provided for the United States only. If you choose to access the App from outside the United States, you do so on your own initiative and are responsible for compliance with local laws.

2. Your account

You are responsible for the accuracy of the information you provide and for keeping your login credentials secure. You are responsible for activity that occurs under your account. Notify us promptly at info@bingemates.com if you suspect unauthorized use.

3. Acceptable use

You agree not to:

• Use the App for any unlawful purpose or in violation of these Terms;
• Harass, abuse, impersonate, or harm other users;
• Post content that is unlawful, infringing, or otherwise objectionable;
• Attempt to access accounts, data, or systems that are not yours, or circumvent the App's security or access controls;
• Scrape, harvest, or bulk-collect data from the App or its APIs, or interfere with the App's normal operation.

4. Your content

You retain ownership of the content you create in the App, such as reviews and profile information ("Your Content"). By posting Your Content, you grant BingeMates a non-exclusive, worldwide, royalty-free license to host, store, and display it as needed to operate the App, including showing it to the other users with whom you have chosen to connect. You are responsible for Your Content and represent that you have the rights to post it.

5. Our intellectual property

The App, including its software, design, branding, and the "BingeMates" name and logo, is owned by BingeMates LLC and is protected by intellectual property laws. These Terms do not grant you any right to use our branding without our prior written permission.

6. Third-party content and services

TV show information in the App is provided by The Movie Database (TMDB). This product uses the TMDB API but is not endorsed or certified by TMDB. Streaming-availability information may be provided by third parties and is offered for convenience only; we do not guarantee its accuracy. Your use of third-party services (such as Google or Apple sign-in) is subject to their own terms.

7. Termination

You may stop using the App and delete your account at any time from within the App. We may suspend or terminate your access if you violate these Terms or if necessary to protect the App or its users. Provisions that by their nature should survive termination (such as intellectual property, disclaimers, and limitation of liability) will survive.

8. Disclaimers

The App is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or secure, or that recommendations or third-party data will be accurate.

9. Limitation of liability

To the fullest extent permitted by law, BingeMates LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising out of or relating to your use of the App. Our total liability for any claim relating to the App will not exceed one hundred U.S. dollars (US$100).

10. Governing law

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-laws rules. You agree that any dispute relating to these Terms or the App will be resolved in the state or federal courts located in Massachusetts.

11. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Effective date" above. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.
